7. Performance Disclaimer

8. Advertising & Third-Party Platforms

• Advertising spend is separate from Agency fees

• The Client is responsible for platform budgets

We may use platforms such as:

• Google Ads

• Meta (Facebook/Instagram)

• Website hosting and analytics tools

We are not liable for:

• Platform changes or outages

• Account suspensions

• Performance fluctuations

9. Intellectual Property

​

• Website content (branding, text, design) is owned by ELK Partners

• Client deliverables may be used by the Client upon full payment

ELK Partners retains ownership of:

• Processes and methodologies

• Results Data

We reserve the right to showcase work for portfolio and marketing purposes.

Clients may not directly engage ELK Partners team members or contractors during the agreement and for 6 months after termination without written consent.
